ACCEPTANCE OF TERMS

The customer agrees to the following terms by ordering from Express Seed Company.

CREDIT APPROVAL

To open an account a credit application must be completed. To receive an application, please contact the Credit Department at 800-221-3838.

PAYMENT TERMS

Upon approval of credit, invoices are payable 30 days after the invoice date. A charge of $50.00 will be assessed on all returned checks. If credit has not been established, payment is due when the order is placed. Visa, MasterCard, and Discover are accepted.

FINANCE CHARGES

A monthly finance charge of 1.5% per month (18% per annum) or the maximum interest rate allowed by law will be added to past due accounts.

PRICES & DISCOUNTS

All prices are listed in US currency. Prices are subject to change without notice. Volume discounts may be available on some products. Please contact your local sales representative.

ACKNOWLEDGMENTS

Please check your acknowledgments carefully upon receipt for any listed changes in ship dates, varieties, or quantities due to availability.

SHORTAGES & SUBSTITUTIONS

All items are offered subject to their availability. We will substitute as needed, unless you request "no substitutes" when your order is placed.

SEED RETURNS

Because we have no control over the environment in which your seed is stored after leaving our premises, we will not accept returns of merchandise for any reason except in the unlikely event of a conclusive error on our part in filling your order. All returns must be approved in advance by phoning our Customer Service Department at 800-221-3838.

SHIPPING METHODS

Plug & Plant Shipping:
Shipping methods vary by supplier. Please contact your local sales representative for details.

Express Seed Company reserves the right to change shipping methods to the least expensive carrier, or to change methods anytime the original method is unavailable or unacceptable due to weather conditions, without prior notification.

CANCELLATIONS OF PLUG & PLANT MATERIAL

Due to the fact that most plugs and plant material are grown per order, no cancellations will be accepted once propagation has begun. Complaints must be made within 24 hours of receipt.

INTERNATIONAL ORDERS

Please contact your local sales representative regarding all orders which are to be shipped outside of the United States.

WARRANTY & LIMITATION OF LIABILITY

Subject to the limitations of liability herein set forth, we warrant that seeds, plugs, plants, and bulbs sold are as described on the container, within recognized tolerances. Our liability on this warranty is limited to the amount of the purchase price of the product. In no event shall we be liable for the crop, or for any loss due to the failure, impairment or quality thereof or varietal variance therein, whether such loss results from breach of the foregoing warranty, from breach of any other provision of the buyer's contract for purchase of said product, or from any other cause. If the materials sold are not as described, the customer shall have the right to recover the purchase price from seller, and no other remedy. The seller shall not be responsible for loss of any product, profit, or any other indirect special or consequential damages. We are not responsible for loss or damage caused by delays in delivery from strikes, acts of war, fire, casualty, inability to obtain materials, or other causes beyond our control.

Freight Claim Information

In the event your shipment from Express Seed Company or one of our many quality suppliers has been delayed and/or damaged by the freight carrier, please follow the instructions listed below to insure proper reimbursement. DO NOT REFUSE THE SHIPMENT or you will lose your right to file a claim. Express Seed Company will be helping our customers initiate all freight claims. Please contact our office within 24 hours of receiving your delayed/damaged order to receive your claim number.

Claims involving Air Freight
  • When picking up order, note any box damage on the airbill.
  • If interior damage is suspected, obtain the telephone number of the airline's freight claim desk before leaving.
  • As you unpack the product, check for damage.
  • If damage has been found, report it immediately to the airline's freight claim desk before leaving the airport. Be prepared to give the airbill number to the airline representative and the dollar amount of damage. Be sure to get a copy of the claim for your records.
  • Claim forms will be sent directly to you and you are responsible for completing and returning these forms to the airline.
  • Once your claim has been filed, notify Express Seed Company by calling 1-800-221-3838.
Claims involving FedEx
  • When the product is delivered, note any box damage on the airbill.
  • If interior damage is suspected, unpack the damaged boxes while the carrier is still present to show them any interior damage.
  • Record the damage on the airbill and call FedEx at 1-800-238-5355 to report the damage. Be prepared to give the airbill number to their representative and the dollar amount of damage. Be sure to get the name of the representative you speak with for your records.
  • Once your claim has been filed, notify Express Seed Company by calling 1-800-221-3838.

HELPFUL HINT: Taking photos of the damaged product is an excellent way to support your claim.

NOTE: No matter what transportation method is used, Express Seed is not liable for any frozen or damaged shipments. Express Seed will ship all freight claim replacement orders at the expense of the customer.

SEED SALES RESTRICTIONS

Seed products sold through this site are for the use and purpose of greenhouse production and are not intended for the use in retail packaged seed sales.
